This matter is taken up through hybrid mode.

Heard the learned counsel for the Petitioner and the learned counsel for the State.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 20th January, 2022 passed by the learned Gramya Nyayalayacum-Judicial Magistrate First Class, Dunguripali in G.R. Case No.131 of 2021 wherein N.B.W.(A) has been issued against him.

It is stated by the learned counsel for the Petitioner that while the Petitioner was interimly protected in a petition under Section 438 of Cr.P.C., Investigating Officer has filed the charge sheet and sought for issuance of N.B.W.(A) against the Petitioner, pursuant to which, N.B.W.(A) has been issued.

However, since the Court is not dealing with the matter under Section 438 of Cr.P.C., I am not inclined to entertain this petition, but liberty is given to the Petitioner to seek recall of the said order before the Magistrate concerned, if so advised. 6.

With the aforesaid order, this Criminal Misc. Case stands disposed of.
