1. The matter is taken up through Hybrid mode.
2. Heard Mr.Panda, learned counsel for the Petitioners and Mr.Nanda, learned counsel for the State.
3. The Petitioners have prayed to release them under Section 438 Cr.P.C. in connection with Madhupatna P.S.Case No.132 of 2022 corresponding to G.R.Case No.583 of 2022 pending in the court of the learned S.D.J.M.(S), Cuttack for alleged commission of offences under Sections 323/506/354/354-B/325/34 of the IPC.
4. It is submitted on behalf of the Petitioners that they are the first wife and sons of the informant and the dispute arose as the husband came with second wife to stay in the same house. It is further submitted that the Petitioners have no criminal antecedents and case and counter case has been lodged by both parties against each other.
5. Upon hearing Mr.Nanda, learned counsel for the State and considering the nature of allegations as well as background facts,
it is directed that in the event of arrest of the Petitioners in the aforesaid case, they shall be released on bail on such terms and conditions as the arresting officer may deem just and proper including the condition that, they shall cooperate with investigation by appearing before the I.O. as and when directed.
6. The ABLAPL is accordingly disposed of.
7. Urgent certified copy of this order be granted on proper application.
