2. Heard Mr.Mohapatra, learned counsel for the Petitioner and Mr.Nanda, learned counsel for the State.

Upon hearing the learned counsel for both parties and considering the nature of allegations and the statement of the victim-informant, I am not inclined to exercise the discretion under Section 438 Cr.P.C. in favour of the Petitioner.
