The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 18.07.2011 passed by the learned J.M.F.C., Pattamundai in G.R. Case No.142 of 2011 taking cognizance of the offences under Sections 302, 498-A of IPC and Section 4 of the D.P. Act.

Learned counsel for the petitioner seeks for an adjournment of this case. Since this case is of the year 2011, I am not inclined to adjourn this matter further on the ground stated.

Considering the facts and circumstances of this case, this Court is not inclined to interfere with the impugned order of cognizance. Hence, this CRLMC filed challenging the impugned order of cognizance being devoid of any merit stands dismissed. Interim order dated 19.12.2011 passed by this Court stands vacated.

However, liberty is given to the petitioner to raise all such contentions at the time of framing of charge, if the charge has not been framed in the meanwhile.
