1. The Petitioner has prayed to release him under Section 438, Cr.P.C. in connection with Rajkanika P.S. Case No.104/2022 corresponding to G.R. Case No.223/2022 pending in the court of learned J.M.F.C., Aul for alleged commission of offences under Sections 279/379/411, I.P.C. and Section 21 of the MMDR Act.
2. Heard Mr. J. Mohapatra, learned counsel for the Petitioner as well as Mrs. S. Pattanaik, learned Additional Government Advocate for the State-Opposite Party.
3. It is submitted on behalf of the Petitioner that he is the driver of the pick-up vehicle and the coal bags were transported on the instruction of the owner of the vehicle. It is further stated that the Petitioner was unaware of source of such coal bags and he has no previous record of criminal antecedents.
4. Upon hearing Mrs. S. Pattanaik, learned A.G.A. for the StateOpposite Party and considering the submissions made, it is
directed that in the event of arrest of the Petitioner in the aforesaid case, he shall be released on bail on such terms and conditions as the arresting officer may deem just and proper including the condition that, he shall cooperate with the investigation by appearing before the I.O. as and when directed.
5. The ABLAPL is disposed of.
6. An urgent certified copy of this order be granted on proper application.
