This matter is taken up through hybrid arrangement Order No.

(virtual/physical mode).

The Petitioner having been implicated in Jashipur P.S. Case No.90 of 2020 corresponding to C.T. Case No.340 of 2020 registered for alleged commission of offence under sections 406/409/420/468/471/120-B/34 IPC pending on the file of the learned S.D.J.M., Karanjia, has filed this application under section 438 Cr.P.C. for his release on bail in the event of his arrest.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions and keeping in view the serious nature of accusation as to the financial irregularities and misappropriation of earmarked fund under MGNREGS with

// 2 // reference to the job, he is entrusted with as those emanate from the materials on record; I do not find it to be a fit case for grant of anticipatory bail to the Petitioner. It is, however, observed that in the event the Petitioner surrenders before the court in seisin of the aforesaid case and moves for his release on bail, the same shall be considered on its own merit without being influenced by this order and disposed of in accordance with law. 5.

Accordingly, the ABLAPL stands dismissed. Interim order passed on 29.07.2020 does no more survive. 6.

Issue urgent certified copy as per rules.
