1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 9th February, 2022, in connection with Economic Offence P.S. Case No.4/2022 corresponding to C.T Case No.867/2022 pending in the court of learned S.D.J.M., Bhubaneswar for the alleged commission of the offence under Sections 419/420/467/471/120-B/34 I.P.C. read with Sections 66(C) and 66(D) of the Information Technology Act.
4. It is alleged that the Petitioner sent a message to the informant asking him to send his bank details including OTP
// 2 // utilizing which the Petitioner is said to have withdrawn a sum of Rs.30064.89 from the account of the informant. It is submitted that the Petitioner was remanded in this case on the basis of the statement of the co-accused and there is no other material to show his involvement in the alleged occurrence.
5. Considering the submissions made, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case. Further, he shall furnish cash security of Rs.30,000/-(Rupees Thirty Thousand) in the shape of short term fixed deposit in any nationalised Bank being pledged to the court below. He shall not leave the territorial jurisdiction of the Court without obtaining leave. The court below shall insist upon two sureties for such amount as may be deem fit and proper. Out of whom one must be his blood relation and the other must belong to the district of Khordha.
6. The BLAPL is disposed of.
7. Urgent certified copy of this order be granted on proper application.
