1. This matter is taken up through hybrid mode. Order No.
2. Surrender certificate has been filed in Court today indicating that the Petitioner has surrendered to custody on 22nd August, 2022 after expiry of the period of interim bail. The same be kept on record. .
3. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
4. This is the second journey of the Petitioner to this Court after rejection of his earlier bail application on 16th May, 2022 since
// 2 // in the mean time charge sheet has been submitted and the case has been committed to the court of session for trial.
5. The Petitioner is in custody since 18th March, 2022 in connection with Jharsuguda P.S.
Case No.151/2022 corresponding to G.R No.676/2022 pending in the court of learned S.D.J.M., Jharsuguda for the alleged commission of the offence under Sections 435/436/506 of I.P.C.
6. The allegation is that the Petitioner was in love with the informant, but their relationship was severed in 2016 and thereafter the informant married another person. For that reason, the Petitioner is alleged to have held a grudge against the informant and also threatened to do away with her life on some occasion. On the date of occurrence, the informant and her husband found that that someone had set fire to a vehicle as also their house at night. The complicity of the Petitioner is sought to be established only because of some missed calls emanating from his number to the informant's mobile phone. Save and except the above, there is no further allegation against the Petitioner to show his complicity.
7. Considering the above facts, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall
// 3 // appear before the court below on each date of posting of the case without fail.
8. The BLAPL is disposed of.
9. Urgent certified copy of this order be granted on proper application.
