This writ petition has been filed for release of Hydraulic Excavator 320-D, which has been seized by the Financer-`Srei Equipment Finance Limited, Rayagada.

Mr. Parhi, learned counsel for the Petitioner submits that since a proceeding is pending before National Company Law Tribunal, Kolkata in respect of the Finance Company, he does not want to press the writ petition and prays for withdrawal of the same.
