This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 30th September, 2011 passed by the learned Additional Sessions Judge (FTC-I), Bhadrak confirming the order dated 3rd December, 2008 passed by the learned S.D.J.M., Bhadrak in Misc. Case No.159 of 2004 under Section 125 of Cr.P.C. fixing monthly maintenance @ Rs.750/-.

No one appears on behalf of the Petitioner when the matter is called.

The case is of the year 2011. Defect, as pointed out by the S.R., has not been removed.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.
