Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 18.07.2021 in connection with Katarbaga P.S. Case No.141 of 2020 corresponding to S.T. Case No.89 of 2021 pending in the Court of learned 1st Addl. Sessions Judge, Sambalpur for the alleged commission of offence under Sections 450/376(1)/323 of IPC.

It is alleged that the petitioner entered into the house of the victim, who is a married lady, in an intoxicated condition and after assaulting her also forcibly raped her.

Considering the nature of allegation and existence of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore, rejected. It is however open to the petitioner to renew his prayer for bail after examination of the victim during trial. 6.
BLAPL is accordingly rejected.
