This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the criminal proceeding in 2(b)C.C. No.12 of 2011, arising out of Barbil Range O.R. Case No.196 BL of 2011-12, pending in the Court of J.M.F.C., Barbil.

No one appears on behalf of the Petitioner when the matter is called. However, learned counsel for the StateOpposite Party is present. 4.
The case is of the year 2011.

As such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution.

However, if the case is still pending and charge sheet in the aforesaid case has been filed, the Petitioner may seek quashment of the cognizance/charge, if framed, if so advised. 8.
Interim order dated 10th April, 2012 passed by this Court in Misc. Case No.3264 of 2011 stands vacated. 9.
Order be communicated to the court concerned forthwith.
