This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioners for anticipatory bail.

The petitioners seeking pre-arrest bail in connection G.R. Case No.114 of 2022, arising out of Sarankul P.S. Case No.53 of 2022 pending in the court of learned J.M.F.C., Odagaon for commission of offence punishable under Sections 498(A)/294/506/34 of I.P.C. read with Section 4 of Dowry Prohibition Act, 1961. 5.

Considering the nature of allegations and gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioners. However, it is observed that, in the event the petitioner surrenders before the learned J.M.F.C., Odagaon in G.R. Case No. 114 of 2022 corresponding to Sarankul P.S. Case No. 53 of 2022 within a period of three weeks from today, the petitioners shall be released on

// 2 // bail on such terms and conditions as the learned Magistrate may deem fit and proper subject to condition that he shall be cooperate with the Investigating Officer as and when required for the purpose of investigation.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
