Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

The petitioners have approached this Court seeking the following relief:- "It is therefore prayed that this Hon'ble Court may graciously be pleased to consider the facts stated in this petition, admit, issue Rule NISI calling upon the Opp. Parties to show cause as to why a writ of mandamus shall not be issued against them for illegal eviction of the teen scanty lever from the shop room and if the Opp. Parties will show no cause or show insufficient cause then the above rule may be made absolute against them by quashing Annexure-2 series and allowing the prayer of the petitioners;
And any other writ (s)/ order(s)/ direction(s)/ Order(s) be passed as deem fit and proper;"

In course of hearing, it is brought to the notice of this Court that ventilating the self-same grievance, the petitioners have
submitted a representation to the Block Development Officer, Jhumpura on 13.06.2022. Since the representation is pending, this Court is not inclined to interfere at this stage. However, the writ petition is disposed of directing the BDO, Jhumpura to dispose of the representation dated 13.06.2022 within a period of two weeks from the date of receipt of certified copy of this order. Till such time, no coercive action shall be taken against the petitioners. It is open to the petitioners to raise all such grounds as are available to them before the B.D.O., Jhumpura for which necessary opportunity of hearing shall be given to them.

Urgent certified copy of this order be granted on proper application.
