1. This matter is taken up through hybrid mode. 1.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 16.04.2022 in connection with Malkangiri P.S. Case No.212 of 2022 corresponding to G.R. Case No.256 of 2022 of the Court of learned S.D.J.M., Malkangiri for the alleged commission of offence under Section 395 of IPC. 4.

It is alleged that the petitioner being associated with several other persons entered into the house of the informant and committed dacoity by taking away Rs.1 lakh and 18 tola of gold ornaments.

It is submitted that the FIR was lodged against unknown persons and the petitioner has been implicated basing on the statement of the co-accused and nothing was recovered from the possession of the petitioner. No T.I. parade was conducted. 6.

Considering the submissions, materials on record and the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on

such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
