Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. 3.
Mr. R. K Sahoo and associates have appeared on behalf of the informant and also Vakalatnama and affidavit filed on behalf of the informant is taken on record.

The petitioner is an accused in Special Case No.32 of 2022, on the files of learned Additional Sessions Judge-cumSpecial Judge, Keonjhar, arising out of Telkoi P.S. Case No.120 of 2021, under Sections 363/366/376(2)(n)/376(3) of IPC read with Section 6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Keonjhar, by order dated 31.05.2022 in the aforementioned case, the present BLAPL has been filed.

Considering the tenor of the 164 Cr.P.C. statement of the victim and the affidavit filed by the informant-father of the victim inter alia absolving the petitioner on the accusation, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
