Heard Mr. Amitav Das, learned counsel for the petitioners and Mr.D.K. Mohanty, learned Additional Standing Counsel for the State.

Petitioners are aggrieved by the order reducing their area of operations for preparation and distribution of THR materials for Bhogarai ICDS project in the district of Balasore from Gram Panchayats to Gram Panchayats, though the performance of Petitioner No.1, i.e. Kalimata Self Help Group, Balasore was never found to be deficient. According to him, the impugned order dated 01.06.2022 passed by District Social Welfare Officer, Balasore-Opposite Party No.3 under Annexure-9 is

Relying on the order dated 16.8.2021 under Annexure-1, learned counsel for the Petitioners submits while the Petitioner No.1 was allotted 20 Gram Pahcnayats whereas Maa Mangala Coir SHG, opposite party no.5 was allotted 12 Gram Panchayats. However, by issuing the impugned order, the area of operation of Kalimela SHG was reduced and opposite party no.5 has increased by 2 Gram Panchayats.

Mohanty, learned Additional Standing Counsel relying on the "Revised Guidelines for Implementation of Take Home Ration, (Supplementary Nutrition Programme of ICDS and Scheme for Adolescent Girls) submits that the Petitioners should have approached the Collector in the matter instead of approaching this Court as indicated under Annexure-7 of such guidelines.

Mr. Das, learned counsel for the Petitioners submit that liberty may be granted to the Petitioners to approach the Collector-cum-District Magistrate, Balasore (Opposite Party No.2) by filing appropriate petition and further submits that the said opposite party be directed to take the

// 3 // motion within a stipulated period.

Considering the submission made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioners to file a representation before the Collector and District Magistrate Balasore, opposite party no.2 within two weeks along with a copy of this order to the office of the opposite party no.2. In the event such a representation is received, the opposite party no.2 is directed to take a decision on the same in accordance with law within a period of four weeks after giving an opportunity of hearing to the petitioner as well as opposite party no.5.

With the above direction, the writ petition stands disposed of.
