The matter is taken up through hybrid arrangement Order No.

(virtual/physical) mode.

This is the second journey of the Petitioner who is in custody in connection with S.P. CBI P.S. Case No.RC 13/S/2014-Kol corresponding to SPE Case No.08 of 2014 pending on the file of learned ACJM-cum-Special Magistrate (CBI), Bhubaneswar, for alleged commission of offence under Section -120-B/420/409 of the IPC read with Section-4/5/6 of the Prize Chits and Money Circulation Schemes (Banning) Act, in filling this application under section 439 of the Cr.P.C. for reconsideration of his prayer for grant of bail to the Petitioner in the above mentioned case.

Heard learned Counsel for the Petitioner and Mr. S. Nayak, learned Special Public Prosecutor (CBI). 4.

Keeping in view the submissions made, the record being perused, it is seen that the Petitioner had last moved the Trial Court for release on bail on 19.06.2020 and in the

// 2 // meantime, the trial having progressed and there has been some developments in the matter.

In the above state of affairs, at this stage, while being not inclined to reconsider the prayer for grant of bail to the Petitioner; the application stands disposed of granting liberty to the Petitioner to renew his prayer before the Trial Court afresh for his release on bail by citing all such developments which have taken place in the meantime for being taken into consideration in their proper perspective.

It is needless to state that in the event, such a move is made, the Trial Court would do well to consider the matter on merit; further taking into account all such subsequent developments which have taken place in the meantime in their proper perspectives and disposed of the same early in accordance with law.

The BLAPL is accordingly disposed of.

Issue urgent certified copy as per rules.
