Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 11.04.2022 in connection with Baghamari P.S. Case No.37 of 2022 corresponding to G.R. Case No.528 of 2022 pending in the Court of learned s.d.j.m., Khurdha for the alleged commission of offence under Sections 379/34 IPC.

It is alleged that the petitioner along with other persons committed dacoity by taking away several electronic articles including laptops from a Tata ACE vehicle. It is submitted that the stolen articles have been recovered in the meantime. The petitioner was implicated on the basis of the statement of the co-accused. It is further submitted that one of the co-accused, namely Tuna @ Prafulla Nayak has been released on bail as per order passed by this Court in BLAPL No. 4236 of 2022.

Considering the above facts, submissions made and the period of detention in custody, I am inclined to allow the prayer for bail.

Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
