This matter is taken up through Hybrid Mode.

Learned counsel for the State on instruction submits that notice was served on 10.07.2022, but there is no appearance on behalf of the informant/victim, when the matter is called. 3.

Heard learned counsel for the parties.

The petitioner is an accused in connection with T.R. Case No. 1 of 2022 arising out of Jatni P.S. Case No. 556 of 2021, pending on the file of the learned Special Judge (POCSO)-cum-Addl. Sessions Judge, Bhubaneswar for the alleged commission of offence under Sections 363/ 366/ 376(2)(n)/376(3) of the I.P.C. read with Sections 6 of the POCSO Act.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Special Judge

(POCSO)-cum-Addl. Sessions Judge, Bhubaneswar by Order dtd.4.05.2022, the present BLAPL has been filed. 6.

Perused the 164 Cr.P.C. statement of the victim. 7.

Considering the tenor thereof and keeping in view that the Charge Sheet has already been filed on 2.03.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 8.

The BLAPL thus stands disposed of.
