This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners as well as learned counsel for the State. Perused the record and the materials. 3.
The petitioner is an accused in C.T. Case No.19 of 2022 on the file of learned S.D.J.M., Baripada registered under Sections 379/188/668/34, I.P.C. and Section 51 of the Orissa Mines and Mineral (Prevention of Theft Smuggling Activities) Act, 1989 corresponding to Kuliana P.S. Case No.4 of 2022. 4.
The case was registered on the F.I.R. lodged by the Tahasildar, Kuliana alleging that despite promulgation of Section 144, Cr.P.C. at village Duvia by the Sub-collector & Sub-Divisional Magistrate, Baripada on 17.12.2021, which was promulgated by the police of Kuliana Police Station, on 03.01.2022 one vehicle bearing registration No.OD-11-3392/3393 was found extracting and transporting sand from the plot in respect of the said Section 144, Cr.P.C. promulgation has been made.

Considering the submissions and the materials placed before the Court, it is directed that the petitioner on the event of arrest in the aforesaid case shall be released on bail on such terms and conditions as deemed just and proper by the Arresting Officer. 6.
The Bail Application is accordingly disposed of. Urgent certified copy of this order be granted on proper application.
