Heard Mr. S. Satpathy, learned counsel for the petitioner and Mr. S. Palit, learned counsel appearing for opposite party no.1.

The petitioner has filed this writ petition seeking direction to opposite parties no.1 to 3 to declare him as the pass out student of "Managerial Economics" Paper in the back paper examination on the basis of Annexure-2 by awarding him at least 30 marks (including out of syllabus question) in the said back paper and grant him MBA certificate as the pass out MBA student of the session 201113. 4.

Mr. S. Satpathy, learned counsel for the petitioner states that though the petitioner has been issued with MBA pass

certificate, but there was delay in issuing the same by the authority causing irreparable loss to him.

Mr. S. Palit, learned counsel appearing for opposite party no.1 states that after making due evaluation, MBA certificate has been issued to the petitioner. 6.

Considering the contentions raised by learned counsel for the parties and after going through the records, since the petitioner has already received MBA certificate, the relief sought has been granted to him. But if the petitioner has sustained any loss, he may approach the appropriate forum claiming damages.

With the above observation, the writ petition stands disposed of.

Issue urgent certified copy as per rules.
