Considering the prisoner's petition, the Vakalatnama filed by the Hemanta Kumar Tripathy advocate and associates is accepted.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 21.05.2022 in connection with Barbil P.S. Case No. 97 of 20221 corresponding to G.R. Case No. 333 of 2021 pending in the court of learned J.M.F.C., Barbil for the alleged commission of offence under Sections 379/407/420/120-B/34 of IPC. 5.
It is submitted that the petitioner was arrested nearly one year after the alleged occurrence and his only role therein is that he changed the number plate of the vehicle carrying the stolen materials.

Considering the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such
terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
