This matter is taken up through hybrid mode.

The grievance of the Petitioner in this writ petition is with regard to inaction of the Regional Transport Officer, Bhubaneswar-Opposite Party No.2 in allowing transfer of the vehicle bearing Registration No.OD-33-S-1666(Tractor) in his favour.

Mr. Sai, learned counsel by filing Vakalatnama in Court today enters appearance on behalf of the Opposite Party No.4., who is the registered owner of the Tractor. It is his submission that the consumer dispute viz C.D. Case No.352 of 2019 is pending before the District Redressal Dispute Commission, Khurda at Bhubaneswar assailing the action of the Opposite
// 2 // Party No.3-Bank in seizing the vehicle without following due procedure of law. Since the matter is sub-judice before learned Commission as stated by Mr. Sai, learned counsel for the Opposite Party No.4, interest of justice will be best served, if the Petitioner appears before it and put-forth his grievances. The Opposite Party No.4 is also directed to implead the Petitioner, namely, Khageswar Senapati, as a party to the aforesaid consumer dispute case.

In order to avoid further delay in the matter, all the parties are directed to appear before learned Commission on 23rd September, 2022 on which date the matter is stated to be posted. 5.
Mr. Mishra, learned counsel for the Opposite Party No.3 and Mr. Sai, learned counsel for the Opposite Party No.4 submit that if the Petitioner appears before learned Commission, the dispute between the parties can be resolved in the said dispute case.

With the aforesaid observation, the writ petition is disposed of.
Urgent certified copy of this order be granted on proper application.
