Undisputedly the Petitioner filed some documents through Annexure-2 establishing that there has not only been initiation of repeated proceedings under the OPLE Act, but all such proceedings have also come to be disposed of holding the Petitioners as encroachers. There has also been deposit of penalty at several point of time as clearly borne from Annexure-2(series). 2.

In the circumstance and as the Petitioners have already been held to be encroachers, there is no illegality in issuing notice vide Annexure-4. In such view of the matter, this Court finds no scope for entertaining the writ petition, which is, hereby, dismissed. It is, however, made clear that if the Petitioners are so advised, may approach appropriate forum.
