Heard learned counsel for the parties.

The petitioner is an accused in connection with G.R. Case No. 125 of 2022 corresponding to Baramba P.S. Case No. 132 of 2022, pending on the file of the learned Court of the JMFC, Baramba, for commission of the offence under Sections 457/395 of the I.P.C Act.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Athagarh by Order dated 8.06.2022 in BLAPL No. 157 of 2022, the present BLAPL has been filed.

The bail application of the petitioner was considered by the Addl. Sessions Judge, Athagarh on 8.06.2022.

Learned counsel for the State submits that on basis of the Case Diary, Charge Sheet was filed on 30.06.2022. 7.
This Court is not inclined to entertain the bail application at this stage giving liberty to the Petitioner to renew his prayer before the lower court below since the earlier consideration was during investigation.

It is needless to state here that the learned court below shall consider the bail application filed afresh on its own merit. 9.
Accordingly, the BLAPL stands rejected.
