This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State. Perused the FIR, Case Diary and other materials placed on record.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No.944 of 2022, arising out of Bolagarh P.S. Case No.152 of 2022 pending in the court of learned S.D.J.M., Khurda for commission of offence punishable under Sections 341/323/324/354-B/506 read with Section 34 of I.P.C.

Considering the nature of allegations and gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is observed that, in the event the petitioner surrenders before the learned S.D.J.M., Khurda in G.R. Case No. 944 of 2022 corresponding to Bolagarh P.S. Case No. 152 of 2022 within a

// 2 // period of three weeks from today, the petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem fit and proper subject to condition that he shall not be threaten, terrorize, influence the prosecution witness including the informant and his family members. This order shall remain valid in the event it is found that there are no similar criminal antecedents against the petitioner.

Accordingly, the ABLAPL is disposed of.
