This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners and learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioners for anticipatory bail.

The petitioners are seeking pre-arrest bail in connection Special G.R.(E) Case No.30 of 2021, arising out of Choudwar P.S. Case No.203 of 2021 pending in the court of learned 1st Addl. District and Sessions Judge, Cuttack for commission of offence punishable under Sections 290/304-A of I.P.C. read with Section 135 Electricity Act. 5.

Considering the nature of allegations and gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioners. However, it is observed that, in the event the Petitioners surrender before the learned 1st Addl. District and Sessions Judge, Cuttack in Special G.R.(E) Case No.30 of 2021corresponding to Choudwar P.S. Case No.203 of 2021within a period of three weeks

// 2 // from today, the Petitioners shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper. 6.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
