This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail, involving offences punishable under Sections 341/294/323/506/353/34, I.P.C.

Learned counsel for the Petitioners does not want to press this bail application so far as Petitioner No.3 - Sudhakar Behera is concerned. Accordingly, the bail application in respect of Petitioner No.3 - Sudhakar Behera is dismissed as not pressed. 5.

So far as Petitioner Nos.1, 2, 4, 5 & 6 are concerned, considering the nature of allegation against them, gravity of the offence, and the facts of the case, I am not inclined to grant anticipatory bail to these Petitioners. However, it is observed that, in

// 2 // the event the Petitioners surrender before the learned J.M.F.C., Tigiria in C.T. Case No.115 of 2022 corresponding to Tigiria P.S. Case No.121 of 2022 within a period of three weeks from today, the Petitioners shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper. 6.

The ABLAPL is disposed of accordingly.
