This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No.341 of 2022 arising out of Tomka P.S. Case No.33 of 2022 pending in the Court of learned J.M.F.C., Jajpur Road, DistJajpur for commission of offence punishable under Sections 498(A)/302/304(B)/34 of IPC read with Section 4 of the D.P. Act. 4.

It is submitted at the bar that after investigation, charge sheet has filed inter alia under Section 498A/304B/306 of IPC. 5.

It is further submitted by the learned counsel for the petitioner that taking into account the role ascribed to petitioner, he may be released on pre-arrest bail.

Learned counsel for the State opposes such prayer for bail inter alia relying on the statement of one Pritesh Ku. Rout thereof.

Taking into account that the petitioner is a lady and keeping in view the Proviso under Section 437(1) of Cr.P.C., this Court directs that on surrendering the petitioner shall be released on bail. The terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the ABLAPL stands disposed of.
