This matter is taken up through virtual/physical mode. 2.

The managing committee of Vivekananda School of Integral Education, Badaraghunathpur in the district of Khurda had availed a loan from Varthana Finance (P) Ltd., Bhubaneswar, a non-banking financial institution, for a sum of Rs.1,25,37,692/- during the period 2018-19.

Due to non-payment of installments, the loan account was classified as NPA and demand notice under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 was issued on 9th June, 2022.

Mr. Milan Kanungo, Senior Advocate appears and prays for permission to withdraw the writ petition as proper parties have not been arrayed, as Namita Pattanaik, Petitioner herein is only the secretary of the managing committee, which had availed the loan. The prayer is, thus, for withdrawal and permission to file a fresh one with better particulars.

Counsel for the Opposite Parties has no objection for the same.

In view of the above, the writ petition is dismissed as withdrawn with liberty to file a fresh one for the same cause of action with better particulars.
