1. A preliminary objection has been raised by counsel for the Order No.

Opposite Parties to the maintainability of the review petition relying on the judgment of the Supreme Court in Patel Narshi Thakershi v. Shri Pradyumansinghji Arjunsinghji (1971) 3 SCC 844.

2. Mr. D.P. Mohanty, learned counsel appearing for the Review Petitioner then submits that the present review petition itself be registered as an Interlocutory Application (I.A.) for recall of the order dated 5th November, 2021 passed in A.H.O. No.34 of 1998.

3. The Registry is directed to re-number the present petition as an I.A. for recall of the aforementioned order and place it before this Bench on 18th November, 2011.

4. Reply now be filed by the Opposite Parties/non-Applicants on the basis that the present petition would now be an I.A. for recall. (Dr. S. Muralidhar) Chief Justice (A.K. Mohapatra) Judge S.K. Jena/Secy.
