This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State. Perused the FIR as well as the statement of the petitioner.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner seeking pre-arrest bail in connection G.R. Case No.1099 of 2022, arising out of Baidyanathpur P.S. Case No.164 of 2022 pending in the court of learned S.D.J.M., Berhampur for commission of offence punishable under Sections 419/420/313/120(B)/34 of I.P.C. read with Section 23 & 25 of P.C. & P.N.D.T. Act, 1994.

Considering the nature of allegations and gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is observed that, in the event the petitioner
// 2 // surrenders before the learned S.D.J.M., Berhampur in G.R. Case No.1099 of 2022 corresponding to Baidyanathpur P.S. Case No. 164 of 2022 within a period of three weeks from today, the petitioner shall be released on bail on such terms and conditions as the learned Magistrate may deem fit and proper.

Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
