This writ petition involves the following prayer:- Order No.

"It is therefore prayed that Your Lordships would be graciously pleased to allow this Writ application, issue rule nisi calling upon the Opposite Parties to show cause i) as to why the O.P. No.5 will not be disqualified from the post of Sarpanch and;

ii) why legal action shall not be initiated against her.

And / or pass any such order/(s) as may deem just and proper;"

Reducing his prayer the Petitioner prayed for at least a direction for disposal of the representation at Annexure-3. 3.

On perusal of the representation at Annexure-3, this Court finds, such representation cannot be considered under the provision of Section 26 of the Orissa Gram Panchayat Act. In such view of the matter, this Court declines to grant any relief to the Petitioner by way of this Writ Petition.

The Writ Petition is, accordingly, dismissed. It is, however made clear that if the Petitioner is so advised, may approach under appropriate provision of law to the appropriate authority. (Biswanath Rath) Judge Ayaskanta Jena
