Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 16.08.2020 in connection with Berhampur Town P.S. Case No.146 of 2020 corresponding to G.R. Case No.1289 of 2020 pending in the Court of learned S.D.J.M., Berhampur for the alleged commission of offence under Sections 25(1-B)(a) of Arms Act.

It is alleged that the petitioner was found to be in possession of firearm, which is a country made pistol, with three rounds of ammunitions without any licence. The offence under Section 25(1B)(a) of Arms Act is punishable with imprisonment for a term which may extend to three years. The petitioner has spent nearly two years in custody by now.

Taking into account all the facts and in particular the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the

trial Court on each date of posting of the case without fail. 6.

BLAPL is accordingly disposed of.
