This CMP has been filed assailing the order dated 20th August, 2021 (Annexure-1) passed by learned Civil Judge (Junior Division), Bhubaneswar in I.A. No.1 of 2021 (arising out of C.S. No.1414 of 2021), whereby an application filed under Order XXXIX Rules 1 and 2 read with Section 151 C.P.C. has been rejected.

In course of hearing, Mr. Panda, learned counsel for the Petitioner prays for withdrawal of the CMP to approach the Appellate Authority under Order XLIII Rule 1(r) C.P.C. 4.

In view of such submission, this CMP is disposed of as withdrawn.
