IN THE HIGH COURT OF ORISSA AT CUTTACK

ABLAPL No.7453 of 2022 Basudev Nayak ....

Petitioner Mr. J. Sahoo, Advocate -versusState of Odisha ....

Opp. Party Mr. P.C. Das, A.S.C.

CORAM:

JUSTICE A.K. MOHAPATRA Order No.

ORDER

02.08.2022 I.A. No.969 of 2022 02.

1.

This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2.

Heard learned counsel for the petitioner and learned counsel for the State.

3.

It is submitted by learned counsel for the petitioner that the ABLAPL No.7453 of 2022 was disposed of by order dated 20.07.2022 granting bail to the petitioner but in 4th line of paragraph4, the name of the court has been wrongly mentioned as "J.M.F.C., Banpur" instead of "4th Additional Sessions Judge, Bhubaneswar" and also 5th line of the said paragraph corresponding to "G.R. Case No.154 of 2022" instead of "T.R. Case No.172 of 2022", which mistake also appears in the cause title of the bail application. Hence, modification has been prayed for.

4.

Accordingly, it is directed that in the 4th line of paragraph-4 of the order dated 20.07.2022 it be mentioned as "4th Additional Sessions Judge, Bhubaneswar" in place of "J.M.F.C., Banpur" and in

// 2 // 5th line of the said paragraph "T.R. Case No.172 of 2022" in place of "G.R. Case No.154 of 2022", rest part of the order remaining the same. It is further directed that the petitioner can avail the benefit of the bail order dated 20.07.2022, if he surrenders before the learned 4th Additional Sessions Judge, Bhubaneswar on or before 17th of August, 2022.

5.

The I.A. is disposed of accordingly.

Urgent certified copy of this order be granted on proper application.
