Since the period of tender has already been over by efflux of time, the writ petition has become infructuous. 3.
Accordingly, the writ petition is disposed of, as infructuous. However, if any cause of action still survives, the petitioner is at liberty to pursue its remedy before the appropriate forum, if it so advised, in terms of the agreement/DTCN, which is applicable to it.
