Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 27.05.2022 in connection with Jharsuguda P.S. Case No.293 of 2022 corresponding to C.T. Case No.1398 of 2022 pending in the Court of learned S.D.J.M., Jharsuguda for the alleged commission of offence under Sections 379/411/120-B of IPC read with Section 18(1) of The Orissa Minerals (Prevention of theft, Smuggling & Illegal Mining and Regulation of Possession, Storage, Trading and Transportation) Rules, 2007.

It is alleged that the petitioner, who is the driver of the Truck, was attempting to steal coal in his truck when he was apprehended.

Considering the fact that the truck as well as the coal has been recovered, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the
trial Court on each date of posting of the case without fail. 6.
BLAPL is accordingly disposed of.
