1. This matter is taken up through hybrid arrangement.

2. Heard learned counsel for the parties.

3. The petitioner has filed this writ petition with a prayer to appoint him either in a Group-C Post or in Group-D post befitting to his qualification under the Rehabilitation Assistance Scheme in terms of the Odisha Civil Services (Rehabilitation Assistance) Rules, 1990 together with its Amendment made in 2016 which was prevalent at the time of death of his father.

4. Learned counsel for the petitioner submits that the father of the petitioner was serving as a Trained Graduate

// 2 // Teacher of Raghunath Bidyapitha, Siaria in the district of Cuttack and died in harness on 21.08.2018. Thereafter, the petitioner made representation along with all relevant documents including the death certificate, legal heir certificate and affidavits of the family members before the opposite party No.3/ District Education Officer, Cuttack under Annexure-9 with respect to his appointment under the Rehabilitation Assistance Scheme on 30.08.2019. On receipt of the said representation, the Head Master, Raghunath Bidyapitha, Siaria forwarded it to the District Education Officer/opposite party No.3 but the authority is still sitting over the said representation without taking any decision.

However, considering the above facts and submissions made, this Court disposes of the Writ Petition with liberty to the petitioner to file a fresh representation within a period of fifteen days hence, and the said representation shall be considered and disposed of by the Opposite Party No.3- District Education Officer/opposite party, in accordance with law within a period of two months from the date of receipt of such representation along with a copy of this order.

6. With the aforesaid observation, the writ petition is accordingly, disposed of.
