This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.
This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

The Petitioner is apprehending his arrest in connection with the information lodged by one Duryodhan Swain, Opposite Party No.2 and the present anticipatory bail application has been filed. 5.
It is submitted by the learned counsel for the Petitioner that till date no F.I.R. has been lodged.

Considering the facts and accepting the allegations under non-
// 2 // bailable offences of the Indian Penal Code, this Court is of the opinion that if any case has been registered on the information of Duryodhan Swain, Opposite Party No.2 before the Chandrasekharpur P.S., the Arresting Officer is directed to follow the mandatory provisions under section 41-A of Cr.P.C..
