Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 10.02.2022 in connection with Soro P.S. Case No.387 of 2021 corresponding to C.T. Case No.816 of 2021 pending in the Court of learned J.M.F.C., Soro for the alleged commission of offence under Sections 379 of IPC. 4.
It is submitted that the petitioner was arrested on the basis of the confessional statement of the co-accused. Further, the stolen motorcycle has been recovered from the said co-accused but nothing was recovered from the petitioner.

Learned Addl. Standing Counsel has opposed the prayer for bail by submitting that the petitioner does not belong to the State of Odisha and therefore, he may abscond during trial, if granted bail.

Considering the nature of accusations, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit
and proper to impose including the condition that he shall furnish cash security of Rs.20,000/-. Further, the learned Court below shall insist upon two solvent sureties, out of whom one must be his blood relation and other must belong to the district of Balasore.

BLAPL is accordingly disposed of.
