This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for the Petitioners and learned counsel for the Opposite Parties.

The Petitioners have filed the present Writ Petition with the following prayer:- "(i) The Resolution dated 20.08.2020 under Annexure-2, and Notification dated 28.09.2020 under Annexure-3 and Notification dated 29.10.2020 under Annexure-7 shall not be quashed as illegal and the petitioners shall be transferred back to their parental cadre, department and post. (ii) The inaction of the Opp. Parties in inviting fresh option from the petitioner according to new cadre rules shall not be declared arbitrary, illegal and contrary to settle principle of law.

(iii) And it may be directed to the opposite parties that no coercive action shall be taken against the petitioners till the disposal of the writ application".

Considering the submission made and without expressing any opinion on the merits of the case, the Petitioner is directed to make a fresh representation before

// 2 // the Opposite Party No.1 by enclosing all the relevant documents and citations in support of his claim, if any, within a period of three weeks hence.

It is observed that if such a representation is filed within the aforesaid period, the Opposite Party No.1 shall do well to dispose of the representation within a period of two months. The decision so taken by the Opposite Party No.1 be communicated to the Petitioner within that time. 6.

With the aforesaid observations and directions, the Writ Petition is disposed of.
