This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to transfer the investigation of the cases pending in the Court of Mahila P.S. Case No.46 of 2010 corresponding to G.R. Case No.1209 of 2010 and Berhampur Town P.S. Case No.93 of 2011 pending in the Court of S.D.J.M., Berhampur in G.R. Case No.498 of 2011 to Crime Branch or any independent investigating agency. 3.

Learned counsel for the Petitioner submits that he has not received any instruction from his client and also the present status of the investigation is not known to him. In such premises, he expressed his inability to advance his submission. 4.

A such, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution. 6.

However, if the case is still pending and charge sheet in this case has been filed, the Petitioner may seek quashment of the cognizance/charge, if framed, if so advised. (S. Pujahari) Judge DA
