The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the F.I.R. in Berhampur Town P.S. Case No.110 of 2011, corresponding to G.R. Case No.600 of 2011, pending in the Court of the learned S.D.J.M., Berhampur. 3.
Heard the learned counsel for the parties.

Since the F.I.R. allegation discloses a cognizable offence, this Court is of the view that prayer made in this CRLMC is devoid of merit. Hence, this CRLMC stands dismissed. Interim order dated 12.09.2011 passed by this Court stands vacated.

However, in the meanwhile if the petitioner has been charge-sheeted, he may challenge the order of cognizance. 6.
