1. This matter is taken up through hybrid mode. Order No.

05.

2. Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

3. The petitioner is in custody since 19.05.2022 in connection with Plantsite P.S. Case No.65 of 2022 corresponding to Special G.R. Case No.09 of 2022 pending in the Court of learned 1st Addl. Sessions Judge-cum-Special Judge, Rourkela for the alleged commission of offence under Sections 20(b)(ii)(C) of NDPS Act.

4. It is alleged that some persons were transporting contraband ganja weighing 90 Kg 900 grams when they were apprehended by police. In so far as the petitioner is concerned his complicity was ascertained only on the statement of the co-accused and nothing was seized from his possession.

5. Taking into consideration all the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. Further he shall appear before the IIC of

Plantsite P.S. on every Sunday at 10 a.m. till conclusion of trial and such fact shall be certified by the IIC to the concerned court once in a month.

6. BLAPL is accordingly disposed of.

7. Issue urgent certified copy as per rules.
