Heard learned counsel for the Parties.

The Writ Petition involves a challenge to the demand of premium by Paradeep Port Authority.

In course of submission, learned counsel for the Petitioner submits that since Petitioner has to get huge amount from the contesting Opposite Parties, there is no prohibition in adjusting the premium in the amount required to be paid to the Petitioner. In the process Petitioner attempted to block demand notice by way of Writ Petition.

For the opinion of this Court, Petitioner is to receive amount from the competent authority cannot be a ground for non-payment of the premium issue involving different action. In course of submission learned counsel for the Petitioner submitted that the Petitioner may be provided some time as he is ready to make the premium deposited and request for grant of instalment.

Considering the above request of the Petitioner, this Court observes in the event Petitioner deposits 50% of premium amount within a period of two weeks and makes a request for payment of balance premium at least two in equal instalments within a period of two months, such request of the Petitioner may be considered, keeping in view the undertaking of the Petitioner to clear the whole premium. 6.
