01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard learned counsel for the Petitioner and learned counsel for the Opposite Parties.

3. The Petitioner has filed the present Writ Petition with the following prayer:- "(i) Admit and allow the writ application.

(ii) Call for the records.

(iii) Issue "RULE NISI" calling upon the O.Ps as to why the petitioner shall not be awarded promotional benefits to the post of Superintending Engineer with revision of his pension on such promotional post of Superintending Engineer (PH), though his petty Junior got such post and in case Ops are failed to make counter or insufficient counter make the rule absolute by passing any writ/writs in the nature of.

(iv) to pass an order by way of writ of "MANDAMUS' by directing to the O.P. No. 1 to dispose of the representation vide Annexure-4, dtd.02.06.2022 with a view to disbursing revised pensions and arrears of promotional post of superintending Engineer from the date of this eligibility.

// 2 // (v) Gloring such other reliefs and making such further orders as to it may deem fit and proper in the circumstances of the case.

And for this act of kindness the Petitioners as in duty bound shall ever pray."

4. Learned counsel for the Petitioner further submits that through highlighting his grievances, the petitioner has filed a representation at Annexure-4 to the Writ Petition before the O.P. No.1, but till date nothing has been done in the matter. In such background, learned counsel for the Petitioner prays that a direction be issued to Opposite Party No.1 to take a decision on the above noted petition within a specific time period.

5. Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No.1 to take a decision on the above noted petition in accordance with law within a period of three (3) months from the date of receipt of this order and communicate the result of such exercise to the Petitioner.
