This application under Section 482 of Cr.P.C. has been field by the Petitioners with a prayer to quash the proceeding in G.R. Case No.298 of 2008, arising out of Parajang P.S. Case No.88 of 2008, pending in the court of S.D.J.M., Kamakhyanagar.

The Petitioners seeks quashment of the aforesaid proceeding on the ground of acquittal of the co-accused, who was facing trial with another co-accused.

Even acquittal of the co-accused, who is facing trial in the same set of evidence, being not a ground to acquit other co-

// 2 // accused convicted, this Court is not inclined to entertain the prayer made in this petition on the ground stated. 5.

Accordingly, the CRLMC stands dismissed.
