Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Case No. 96 of 2022 arising out of Jaipatna P.S. Case No. 98 of 2022, pending on the file of the learned JMFC, Jaipatna for the alleged commission of offence under Sections 363/ 376(1)/ 506/109/354-B/34 of the I.P.C. read with Sections 67A of the I.T. Act. 4.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Dharamgarh by Order dtd.10.06.2022, the present BLAPL has been filed.

Taking into account the 164 Cr.P.C. statement of the victim, release of co-accused by the learned court in seisin over the matter and since the Charge-sheet has already been submitted

in the meanwhile, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

The BLAPL thus stands disposed of.
